Burkina Faso: New provisions of the constitutional law now applicable

Under the transitional regime in Burkina Faso, the constitution underwent certain modifications to adapt to the socio-cultural realities of the country. After being adopted on December 30, 2023, by 90% of the members of the Transitional Legislative Assembly (ALT), and following the approval of its adoption by the Constitutional Council on January 12, it is now promulgated.

The transitional president, and head of state, Captain Ibrahim Traoré, carried out the promulgation of the law amending the Constitution, making the innovations introduced in this Constitutional Law No. 045-2023/ALT of December 30, 2023, applicable.

This was done according to a presidential decree signed on January 22, 2024, as reported by the Burkina Information Agency (AIB).

The significant new provisions in Burkina Faso’s constitution particularly concern the formalization of national languages, with French being downgraded from the status of an official language to that of a working language, alongside English.

The new Burkinabe Constitution also includes the establishment of the National Council of Communities.

Additionally, the Economic and Social Council (CES), the Ombudsman of Burkina Faso, and the High Court of Justice were abolished during the constitution revision.
